The ANMF uses nurses and midwives in the eba public sector as a reference agreement for their negotiations in all other workplaces. This is why salaries, allowances and many of the conditions are also stipulated in the agreement on nurses in the public service and in acute private nurses and midwifery conventions. One of the main reasons an ANMF members supported the ACTU`s „Change the Rules“ campaign on the eve of the last federal election. It is an agreement between the employer and the employee that exposes your wages, working conditions, career structures, allowances and rights. The EbA operates with the full force of the law. They are legally applicable and, if not followed by employers, the court may order significant sanctions against them. In 1997, the ANMF negotiated the first Victorian nurse and midwife eBA. At the time of the pressure, the ANMF was negotiating the seventh public sector EBA. The agreement covers about 60,000 nurses and midwives. Their strength in terms of numbers and their ability to take important trade union measures, such as the closure of beds and the abolition of electoral operations, mean that in two decades they have achieved significant improvements in conditions, wages and workloads. Negotiations for smaller jobs followed.
These include private, not-for-profit care centres for the elderly, bush care hospitals, municipalities, palliative care, dialysis, endoscopy, radiology, pathology, family physician clinics and IVF. Enterprise negotiations have been an imperfect system that nurses, midwives and personal assistants have not benefited in the same way. For more information on your representation rights under the Fair Work Act 2009, enterprise agreements and their negotiations, please also: If you are a member of a union authorized to represent your industrial interests in the course of the work to be performed under the agreement, your union is your bargaining representative for the agreement, unless you appoint someone other than your representative or revoke the union position as a representative. Prior to enterprise bargaining, most Victorian nurses and midwives received the same rates of pay, regardless of their employer. You have the right to appoint a negotiator to represent you in negotiations on the agreement or on an issue before the Fair Work Commission on the negotiations on the agreement. There are 250 agreements on Victorian ANMF members who are nurses, midwives and private caregivers for the elderly. These EEAs, which cover many jobs, usually expire after three or four years. Bupa members did not reach the relationships they wanted between nurses with respect to residents.
To achieve the conditions in old private and not-for-profit care, it must be a recommendation of the Royal Commission for The Assistance of the Elderly. However, the Bupa member`s action is proof that the commitment of ANMF members to their EBA campaign has a considerable impact on the outcome. An enterprise agreement is an agreement between an employer and its employees that is covered by the agreement setting the wages and conditions of these workers for a maximum of four years. To enter into force, the agreement must be supported by the majority of workers who voted in favour of the agreement and it must be approved by an independent authority, the Fair Work Commission. Nurses and midwives in larger jobs with more bargaining power, such as the public sector, have more opportunities to take such union action than to pressure an employer to improve their offerings. This explains why there is a pay gap between public nurses and private nurses and private caregivers for the elderly.
